Membership Terms of Service

1. Terms of Acknowledgment and Consent

MarSun DiDi (hereinafter referred to as 'the App') is an NFC (Near Field Communication) technology application service and app operated by 'Mars e-Bank.com Inc.' (hereinafter referred to as 'the Company'). It provides members with augmented application services for NFC tag content. Before using the services of this platform, all users are encouraged to carefully read these service terms and any other related terms published on this platform, and to comply with them diligently.

If you are a minor under the age of eighteen, you must have your parent(s) or guardian read, understand, and agree to all the contents of this agreement and any subsequent modifications before you can register as a member or use or continue to use this service. By using or continuing to use this platform, it is presumed that your parent(s) or guardian have read, understood, and agreed to all the contents of this agreement and any subsequent modifications. Both you and this platform agree that all content related to the use of this service, including expressions of intent, may be represented in electronic format.

2. Member Registration and Account Security

(1) You are required to provide accurate information when applying to become a member of the Company. If any updates are necessary for your personal data, please ensure that you make those updates to receive the best possible service. If you provide incorrect or false information, fail to update your information in a timely manner, omit necessary information required by this shopping website, infringe upon others' name rights or intellectual property rights, or violate any other legal regulations, the Company reserves the right to suspend or terminate your account and deny you access to all or part of the services.

(2) All actions you take while using this service after logging into your account will be considered as your own. This includes, but is not limited to, browsing, retrieving information, querying, updating personal data, participating in promotional activities, and any other actions related to your account's personal interests.

(3) Your account, password, and membership benefits are for your personal use and enjoyment only. Please do not lend, transfer, or share them with others. (4) If your personal data or related account information is leaked due to circumstances attributable to you, allowing third parties the opportunity to use it, you shall bear full responsibility for the actions of those third parties, and the Company shall not be held liable in any way.

(5) If your account or password has been compromised or if any other security issues arise regarding your account, you must notify the Company immediately.

(6)Once your mobile number is linked to your account, it cannot be unlinked except in cases of account security issues such as theft or impersonation, or for other legitimate reasons.

3. User's Legal Obligations and Commitments

You agree not to use the platform services for any illegal purposes or in any illegal manner and commit to complying with the relevant laws and regulations of the Republic of China, as well as all international internet usage conventions. If you are a user from outside the Republic of China, you also agree to comply with the laws of your respective country or region.

You agree and undertake not to use this service for any actions that infringe upon the rights of others or violate applicable laws, including but not limited to:

1. Posting or transmitting any defamatory, abusive, threatening, offensive, indecent, obscene, false, or otherwise unlawful text, images, or files in any form, or any content that disrupts public order or violates moral standards.
2. Infringing on or harming the reputation, privacy, trade secrets, trademarks, copyrights, patents, intellectual property rights, or any other rights of the Company or third parties.
3. Breaching confidentiality obligations established by law or contractual agreement.
4. Impersonating another individual to use this service.
5. Distributing or transmitting computer viruses.
6. Conducting commercial activities without prior authorization from the Company.
7. Publishing, transmitting, or distributing spam, chain letters, illegal or unauthorized multi-level marketing communications, and advertisements; or storing any data that infringes upon the intellectual property rights of others or violates applicable laws.
8. Engaging in conduct that causes annoyance, displeasure, or breaches general online etiquette towards other users of the platform or third parties.
9. Any other actions that are inconsistent with the intended purpose of the platform or that the Company reasonably considers inappropriate.

4. Modification, Suspension, or Interruption of Services

1. You agree that the scope of services provided by this platform may be adjusted, modified, or discontinued based on business needs and prevailing circumstances, without the necessity for individual notifications to members.
2. You agree that the Company may add, modify, or terminate related activities based on actual operational conditions, and will select the most suitable method to inform you.
3. This platform will employ generally accepted technical methods to ensure the normal operation of the system and services. However, under the following circumstances, the platform reserves the right to suspend or interrupt the provision of these services:
   • When necessary maintenance or construction is being conducted on the platform's cloud service infrastructure.
   • When a user breaches any government regulations or the terms and conditions of this service.
   • When natural disasters or other force majeure events occur, or when circumstances beyond the platform's control prevent the provision of services.
   • When the service information is inaccurately displayed or is subject to falsification, alteration, deletion, or unauthorized access due to circumstances beyond the Company's control, or when the system experiences interruptions or fails to operate normally.

5. Protection of Intellectual Property

1. The software, programs, and content provided by advertisers and partners on this platform, including but not limited to written works, images, videos, files, information, data, website architecture, layout, and web design, are owned by the platform or other rights holders in accordance with applicable intellectual property laws. This ownership encompasses, but is not limited to, trademark rights, patent rights, copyrights, trade secrets, and other proprietary rights or legal protections. No individual may use, modify, reproduce, publicly broadcast, adapt, distribute, issue, publicly present, reverse engineer, decompile, or disassemble any of these materials without obtaining prior written consent from the platform or the respective rights holders. Adhering to intellectual property rights is an obligation of all members; any violations may result in liability for damages to the platform, including but not limited to litigation costs and attorney fees.
2. When you submit data to the services provided by the Company, you acknowledge that the data will be publicly accessible. By doing so, you grant the Company the right to reproduce, modify, adapt, or utilize all or part of the content in any form, including the creation of derivative works. The copyright for any such derivative works will be solely owned by the Company.
3. You agree to respect intellectual property rights and avoid any infringement while using this platform's services.
4. All advertisements and promotional content displayed on the webpages are the exclusive property of the Company. Users are prohibited from using any of this content without obtaining prior authorization from the Company.
5. If you engage in any infringement, the platform may suspend services or cancel your membership account.

6. Authorization Granted by Members to the Platform

1. By uploading, transmitting, inputting, or providing any data to the platform, you grant the platform an unconditional right to use, modify, reproduce, broadcast, adapt, distribute, publish, and display such data, and to sublicense these rights to others without objection. You must ensure that such actions by the platform do not infringe on any third-party intellectual property rights. If you do not have the legal rights to the data, do not submit it. Otherwise, you will be responsible for any damages, including legal and attorney fees.
2. For any personal data you upload, transmit, input, or provide, you agree that this website may reasonably collect, process, store, transmit, and use such data to offer additional services, provide user information, compile member statistics, and for any other lawful purposes.
3. You agree to authorize this website to share necessary member information with partner organizations (third parties) for providing personalized or value-added services within the agreed scope. If you do not wish your information to be included in third-party product or service lists, you may notify the website for removal. By doing so, you waive any shopping discounts or prize eligibility outside of this website.

7. Refusal or Termination of Member Use

8. Governing Law and Jurisdiction

The Taipei District Court in Taiwan shall have jurisdiction as the court of first instance, unless mandatory jurisdictional provisions dictate otherwise.

9. Disclaimer

1. The Company makes no express or implied warranties, claims, or representations, including but not limited to warranties of quality, performance, or suitability for a particular purpose.
2. The Company does not guarantee the functionality of this platform concerning the images, text, or other data you upload. You are responsible for assessing the appropriateness of publicly transmitting such data. While the Company strives to ensure data security, it does not guarantee the reliability, accuracy, or proper display of files during transmission and upload. Furthermore, the Company does not assure the security, reliability, integrity, or uninterrupted operation of stored data. If you encounter any errors or omissions in the system, please notify the website immediately.
3. The Company does not guarantee that electronic information transmitted through its webpages, servers, or domains is free from viruses or harmful programs, nor that errors will not occur due to communication disconnections.
